The Keeping Families Together program, announced by the Department of Homeland Security on June 18, 2024, is a groundbreaking initiative aimed at promoting family unity within the immigration system. This program allows noncitizen spouses and stepchildren of U.S. citizens to remain in the United States while they apply for permanent residency.
Who Does This Program Benefit?
This program is especially significant for those who have lived in the U.S. for many years and wish to keep their families intact. It provides a lifeline for approximately 500,000 noncitizen spouses and 50,000 stepchildren, many of whom have deep ties to their communities and have been part of the fabric of American life for decades.
The Application Process
Eligible individuals can request “parole in place,” which permits them to stay in the U.S. without the need to leave for consular processing. This is a vital option that helps families avoid prolonged separations during the application process. However, applicants must be aware that USCIS will rigorously review all applications to prevent fraud, particularly concerning invalid marriage claims.
Current Developments
As of August 26, 2024, a Texas court temporarily halted the program, delaying new requests until September 23, 2024. While USCIS is still accepting applications, they will not grant any pending requests during this period. This situation underscores the importance of staying informed about changes in immigration policy.
