The Department of Homeland Security will end the up-to-540-day automatic extension for Employment Authorization Document (EAD) renewals. The policy shift applies to filings submitted on or after October 30, 2025, with limited exceptions. In practice, noncitizens who relied on the automatic extension to remain employed while renewals were pending may have to step away from their jobs until a new card is approved.
The change affects multiple categories that previously benefited from the automatic extension. Without that buffer, workers face temporary lapses in authorization, and employers must contend with staffing gaps. In sensitive industries such as healthcare and security, the uncertainty could lead to temporary leaves, even dismissals, and a more cautious approach to hiring candidates who depend on EADs.
The policy arrives amid slower adjudications. For certain EAD types, renewals that once turned around in roughly 30 days can now take up to about 90 days under standard processing, increasing the likelihood of interruptions.
There is a financial dimension. Estimates cited by immigration observers indicate that, absent automatic extensions, on the order of 468,000 people could be exposed to temporary loss of work authorization while awaiting renewal. Faced with that risk, some applicants are expected to pay for accelerated processing where available. Premium processing for Form I-765 is largely limited to F-1 OPT and STEM OPT categories, with a 30-day target in exchange for an additional fee. If 25% of that 468,000-person cohort opted for premium processing, the incremental annual revenue from the premium fee alone would approach 197 million dollars, not including standard I-765 filing fees or other surcharges.
In sum, ending automatic extensions narrows the safety margin for workers and intensifies operational pressure on employers. Without a broad acceleration in case processing, the combination of longer timelines and the loss of automatic extensions is likely to produce staffing gaps and more conservative hiring decisions.
