Massachusetts Considers Limits on ICE Actions

Massachusetts Governor Maura Healey has introduced an emergency budget of approximately $411 million that, in addition to funding areas such as healthcare, the prison system, and social programs, includes a proposal likely to spark significant political debate: limiting immigration enforcement operations in several public spaces across the state.

The initiative includes legislation that would restrict the activities of agents from the U.S. Immigration and Customs Enforcement (ICE) in locations considered sensitive, including schools, daycare centers, hospitals, courthouses, and houses of worship.

Under the proposal, federal agents would not be allowed to carry out civil immigration arrests in these locations without a judicial warrant. The plan also seeks to prevent state resources, facilities, or property from being used to assist or facilitate federal immigration enforcement operations.

Healey said the measure is a response to the increase in federal immigration enforcement actions and the growing fear among immigrant communities. According to the governor, many families have begun avoiding hospitals, courts, and even schools out of fear of being detained.

“People are afraid to take their children to school or seek medical care. That doesn’t make anyone safer,” Healey said while announcing the proposal in Boston.

The measure was included in a supplemental budget considered urgent, designed to cover immediate expenses and financial adjustments for the 2026 fiscal year.

However, the proposal has already drawn strong political reactions. Critics argue that restricting federal agents could create obstacles to the enforcement of immigration laws and lead to conflicts between state authorities and the federal government. Supporters, on the other hand, say the measure protects access to essential services and ensures that vulnerable communities do not avoid medical care, education, or legal assistance out of fear of deportation.

If approved by the Massachusetts Legislature, the initiative could place the state at the forefront of the national debate over the limits of cooperation between state governments and federal immigration authorities an issue that has intensified amid tougher immigration policies in the United States.
